These Terms of Use ("Terms") explain the rules for using the Drinking Control iPhone app, its paired Apple Watch app, and related Premium features (collectively, the "App"). By downloading or using the App, or completing a purchase, you agree to these Terms and the applicable Apple Standard End User License Agreement.
Apple's Standard End User License Agreement ("Apple Standard EULA") continues to govern the license for the App, Apple's responsibilities, and the other matters it covers. These Terms supplement the Apple Standard EULA with information specific to Drinking Control. If these Terms conflict with the Apple Standard EULA, the Apple Standard EULA and any non-waivable applicable law will control.
You must have the legal capacity required where you live to accept these Terms and use the App. The App is not intended to encourage anyone to drink, particularly anyone below the legal drinking age where they live. You remain responsible for following all applicable laws concerning alcohol, driving, workplace safety, and the protection of minors.
The App provides tools for recording drinks, reviewing trends, setting personal goals, scheduling reminders, recording wellbeing check-ins, managing a personal cabinet, and using related features on a paired Apple Watch.
Alcohol amounts, calories, trends, goal progress, and other results depend on information you enter, product labels, and general conversion methods. These results may be incomplete or inaccurate.
Drinking Control is a personal recording tool. It does not provide medical advice, diagnosis, treatment, a withdrawal plan, or blood alcohol concentration measurement. It is not a medical device and does not create a doctor-patient or other professional-care relationship. It does not guarantee that any amount of alcohol is safe or appropriate for you.
Do not use the App or its estimates to decide whether to drive, take medication, care for another person, operate equipment, perform a high-risk activity, or delay seeking professional help. Do not drive after drinking. If you experience a medical emergency, severe symptoms, or concerns about alcohol dependence, contact local emergency services or a qualified professional immediately.
Stopping or sharply reducing alcohol use can be dangerous for a person who may be dependent on alcohol. The App is not a detoxification program. If this may apply to you, seek advice from a qualified healthcare professional before making a major change.
Reminders, goals, and wait timers only help you pause and reconsider a choice. They do not physically prevent drinking. You remain responsible for your decisions and safety.
The App does not provide a Drinking Control account or use a developer-operated cloud database to store your personal drink records. Personal records are primarily stored on the current device. Information needed for requested features may be exchanged between a paired iPhone and Apple Watch.
Deleting the App, losing or damaging a device, changing devices, or system cleanup may make local data unrecoverable. You are responsible for deciding whether to retain any available exported content before taking an action that may cause data loss.
You retain ownership of the records, notes, photos, custom drinks, and other content you create in the App. We do not claim ownership of or a license to personal content stored only on your device. When you deliberately export, share, or send content with a support request, you choose the recipient and are responsible for having the right to share that content.
Our Privacy Policy explains how the App handles local data, analytics, advertising-result measurement, photos, notifications, purchases, support, and information you deliberately share.
The App may offer monthly and annual auto-renewable subscriptions and a one-time lifetime purchase. Available products, local prices, taxes, billing periods, trial eligibility, and promotional offers are shown by the App Store before you confirm a purchase.
Monthly and annual subscriptions automatically renew for the period shown on the purchase confirmation screen until you cancel them through your Apple Account subscription settings. Cancellation generally takes effect after the current paid period. Deleting the App does not cancel a subscription.
A trial or promotional offer is available only when the App Store determines that you are eligible. Before purchasing, review the offer duration, the renewal price after the offer ends, and the billing period. Unless you cancel within Apple's required timeframe, a trial may convert to a paid subscription at the displayed standard price.
"Lifetime" means a one-time, non-consumable purchase that unlocks Premium in the current Drinking Control App. It does not guarantee that the App will exist forever, remain compatible with every future operating system, include every future feature, or apply to a different product. Purchased entitlements will be maintained as required by applicable law and App Store rules.
Apple processes purchases and billing. You can use Restore Purchases in the App and manage subscriptions through your Apple Account. Apple determines refund eligibility and outcomes under its rules. We may help investigate a restore failure, but we cannot approve refunds or change Apple billing.
You agree that you will not:
The App's code, design, graphics, branding, built-in content, and related rights belong to us or the relevant rights holder. You receive a limited license to use the App under these Terms and the Apple Standard EULA. You do not acquire ownership of the App.
If you voluntarily send suggestions or issue reports, we may use them to improve the App. This does not give us rights to personal records stored on your device. Personal information included in feedback remains subject to the Privacy Policy.
The App may be temporarily unavailable because of device state, operating-system changes, App Store availability, network conditions, paired-Watch status, or maintenance. We may update features and interfaces for safety, compliance, compatibility, or product improvement. If a change materially affects a purchased entitlement, we will address it as required by applicable law and App Store rules.
To the fullest extent permitted by applicable law, the App is provided "as is" and "as available." We do not guarantee that estimates will be perfectly accurate, that the App will always be uninterrupted, that local data will never be lost, or that using the App will produce a particular change in alcohol use or health outcome.
To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or exemplary damages, or for loss of data, revenue, opportunity, or anticipated savings arising from use of or inability to use the App.
Nothing in these Terms excludes non-waivable consumer rights or limits liability that applicable law does not allow us to exclude or limit. Apple-related warranties and limits of liability are governed by the Apple Standard EULA.
You may stop using and delete the App at any time. You must separately cancel any auto-renewable subscription through your Apple Account.
We may update these Terms when features, purchase methods, or legal requirements change. We will update the date above and provide notice of material changes through the App, release notes, or another reasonable method. An update will not retroactively reduce rights already provided by applicable law.
The governing-law and dispute provisions in the Apple Standard EULA continue to apply, together with mandatory consumer protections where you live. You may contact us first so we can try to resolve a problem, but this does not prevent you from seeking assistance from Apple, a regulator, or a dispute-resolution body with jurisdiction.

When contacting support, describe what happened, the device you used, and the purchase type. Unless necessary to investigate the issue, do not send drink details, health information, complete transaction receipts, or identity documents.
